SERVICES - MEDICARE SET-ASIDES

The Medicare as Secondary Payer (MSP) statute was enacted in 1980 to prevent insurance companies and other payers from unduly shifting the responsibility for medical payments to Medicare. A Medicare Set-Aside (MSA) arrangement is the preferred method of ensuring that Medicare’s interests have been considered when settling workers’ compensation cases involving the closure of future medical expenses. This arrangement “sets aside” a sum of money to be used to pay for future expenses that would have ordinarily been paid by Medicare. The Centers for Medicare & Medicaid Services (CMS) must approve of the MSA arrangement prior to settlement in order to protect individuals, attorneys and others involved in the case from the consequences of non-compliance.
